Yes. Surrogacy programs in Ukraine continue in 2026, and babies born through them leave the country with their parents every month. This article answers the questions intended parents ask most: whether clinics are working, how you get to Kyiv, what safety measures are in place, how long the program takes now, and what has changed since 2022. It is written by Militta, a surrogacy and egg donation agency that has operated in Kyiv since 2017.
Is surrogacy still happening in Ukraine?
It is. The legal framework has not changed: Article 123 of the Family Code and Ministry of Health Order No. 787 still define the parents and the medical procedure. Civil registry offices issue birth certificates, maternity hospitals in Kyiv deliver babies, and the US, UK and EU embassies in Kyiv process travel documents for newborns. Militta’s partner clinic “Lita” in Kyiv performs IVF and embryo transfers, and the agency continues to recruit and screen surrogate mothers.
What has changed since 2022
- Travel. Ukrainian airspace is closed to civil flights. Intended parents fly to Warsaw, Kraków or Rzeszów and continue by train or car to Kyiv (about 8–12 hours). Militta arranges the transfer.
- Where surrogates live. Surrogates in the Militta program live in Kyiv or nearby regions and move to agency-provided accommodation in Kyiv from week 28.
- Timeline. Programs still take 12–18 months; the documents stage after birth can take 2–4 weeks because of embassy appointment availability.
- Contingency clauses. The surrogacy agreement includes provisions for relocation of the surrogate and changes to the delivery plan if the security situation changes.
- Insurance. Standard travel insurance usually excludes Ukraine; specialised policies are available and your coordinator will advise.
How intended parents travel to Kyiv
- Fly to Poland (Warsaw, Kraków or Rzeszów).
- Take the direct train or a car transfer arranged by Militta to Kyiv.
- Stay in a hotel or apartment near the clinic; the agency books it and provides an interpreter.
Most couples travel twice: a short trip of 1–2 weeks for the agreement and, if using their own eggs, for egg retrieval; and a trip of 3–4 weeks around the birth. Everything in between is handled remotely by video call.
Safety measures in the program
- IVF, pregnancy monitoring and delivery take place in Kyiv at the partner clinic and state maternity hospitals, which have operated without interruption.
- Surrogates receive the same medical care and monthly payments as before 2022, plus accommodation from week 28.
- Your coordinator sends updates after every medical visit and is available on WhatsApp.
- If the situation in Kyiv changes materially, the agreement allows the surrogate to be relocated and the delivery plan adjusted.
Who can still take part
Eligibility has not changed: legally married heterosexual couples with a medical indication and a genetic link to the child from at least one spouse. Single intended parents and same-sex couples cannot take part under Ukrainian law; for cohabiting couples Militta offers programs in Georgia.
What it costs in 2026
Militta’s basic program costs $41,500–$48,500 and the guaranteed program $57,300–$68,000, including the surrogate’s compensation, IVF at the partner clinic, delivery and legal documents. Full breakdown: surrogacy cost in Ukraine.
Ukraine or Georgia in 2026?
If you are married and budget matters most, Ukraine remains the most affordable legal option. If you prefer direct flights or are not legally married, Georgia (Tbilisi) offers the same legal certainty at $52,500–$82,500. Both programs are run by the same Militta team, and the coordinator will compare them for your situation during the first consultation.
