Surrogacy Abroad for UK Intended Parents: Ukraine and Georgia

In the UK surrogacy is altruistic only, agreements are not enforceable and finding a surrogate can take years. Militta runs gestational surrogacy programs in Kyiv and Tbilisi for married UK couples: $41,500–$68,000 in Ukraine, $52,500–$82,500 in Georgia, with the local paperwork prepared for your solicitor’s Parental Order application.

Surrogacy law in the UK: why couples go abroad

Surrogacy is legal in the UK, but the framework was written for altruistic arrangements between friends and family. For most couples that means long waits and no legal certainty.

Altruistic only

A surrogate may receive reasonable expenses but not a fee. Commercial surrogacy agencies and advertising for surrogates are prohibited by the Surrogacy Arrangements Act 1985.

Agreements are not enforceable

The surrogate is the legal mother at birth, and if she is married her husband is the legal father, whatever the agreement says.

Parental Order

Intended parents become the legal parents through a Parental Order from the Family Court (Human Fertilisation and Embryology Act 2008, section 54), applied for within six months of the birth. The order is also available for children born abroad.

Waiting time

UK non-profit organisations match a limited number of surrogates each year, and couples commonly wait years for a match.

Going abroad is lawful

UK residents may take part in surrogacy programs in other countries. The Government publishes guidance on the passport and Parental Order process in its “Surrogacy overseas” pages.

Two destinations, one team

Militta is a surrogacy and egg donation agency based in Kyiv since 2017. We run programs in Ukraine with the partner clinic “Lita” and in Georgia with the partner clinic ReproART in Tbilisi. Both countries name the intended parents on the birth certificate by law.

Ukraine (Kyiv)

Married heterosexual couples with a medical indication. $41,500–$68,000. Entry overland from Poland while airspace is closed; programs take 12–18 months.

Georgia (Tbilisi)

Married and cohabiting heterosexual couples. $52,500–$82,500. Direct flights from many European hubs; the country, not the US state.

What changes for a UK couple in Ukraine or Georgia

The medical program is the same for every nationality. Three things are specific to the UK.

The surrogate’s marital status matters

Under UK law a married surrogate’s husband is treated as the child’s father, which affects whether your baby is automatically British. Tell your coordinator at the first call that you are from the UK, so this is taken into account at matching.

Plan a longer stay after the birth

The UK passport or visa route for a child born through surrogacy abroad is slower than for US or EU parents. UK couples should budget for several weeks in Kyiv or Tbilisi after the birth; your UK solicitor will give a realistic timeline.

Parental Order after you return

The Family Court must authorise any payments beyond expenses when it grants the order. UK courts have done this in overseas commercial cases, but you should instruct a UK surrogacy solicitor before signing the agreement.

How the program works, step by step

The same six stages apply in Ukraine and Georgia. Most couples travel twice: a short trip for the agreement and egg retrieval, and a longer stay around the birth.

  1. Free consultation

You tell us your country, marital status and medical history. We say honestly whether Ukraine, Georgia or neither fits your case, and send a written quote.

  2. Documents and agreement

Apostilled marriage certificate, medical letter, passports. Partner lawyers prepare the surrogacy agreement in English and the local language. Signing takes one short trip, or can be arranged by proxy where the law allows.

  3. IVF and matching

Egg retrieval from the intended mother or a screened donor, embryo creation and PGT if requested. The surrogate is matched after medical and psychiatric screening; you approve the profile.

  4. Transfer and pregnancy

Embryo transfer at the partner clinic. Monthly reports after every check-up, ultrasound scans by email or video call. The surrogate moves to agency accommodation in the capital from week 28.

  5. Birth

Delivery in a state maternity hospital in Kyiv or a clinic in Tbilisi. You are notified when labour starts and can be present at the birth.

  6. Birth certificate and travel documents

The local birth certificate is issued in your names within days. Your coordinator books the embassy appointment and prepares the apostilled translations your country requires.

Bringing your baby home to the UK

The steps after the birth in Kyiv or Tbilisi, in the order they happen.

  1. Local birth certificate in your names (Ukraine: civil registry office, usually within a week; Georgia: Public Service Hall).

  2. Apostille and certified translation of the birth certificate, the surrogacy agreement and the surrogate’s consent. Militta’s partner lawyers prepare these.

  3. Application for a British passport, or for registration as a British citizen followed by a passport, through the UK mission. The route depends on whether the genetic father is British and on the surrogate’s marital status. Your solicitor confirms which applies.

  4. If a passport is not available immediately, a visa or entry clearance for the child to travel to the UK.

  5. Parental Order application in the Family Court within six months of the birth. The surrogate signs her consent after the sixth week; we obtain it and send it to your solicitor.

Militta prepares and apostilles the Ukrainian or Georgian documents and books the embassy appointment. The UK side, including the Parental Order, is handled by your solicitor; we work with the one you choose.

Cost compared with the UK

UK altruistic surrogacy is commonly quoted at £12,000–£20,000 in surrogate expenses plus clinic fees, but only for couples who find a surrogate. US programs usually exceed $150,000. Militta’s programs are fixed-price and include the surrogate’s compensation, IVF, delivery and legal documents.

FAQ

Is it legal for a UK couple to use a surrogate abroad?

Yes. UK law prohibits commercial surrogacy arrangements within the UK but does not prevent UK residents from taking part in a lawful program in another country. After the birth the parents apply for a Parental Order in the UK.

Will a UK court grant a Parental Order after a Ukrainian or Georgian program?

Parental Orders are available for children born abroad if the statutory conditions are met: at least one applicant is genetically related to the child, the surrogate consents after six weeks, and the court authorises the payments made. A UK surrogacy solicitor will assess your case before you sign.

How long after the birth can we fly home?

Longer than most nationalities. Allow several weeks in Kyiv or Tbilisi for the birth certificate, apostilles, the UK passport or visa decision and travel. The exact time depends on the route your solicitor recommends.

Can single UK intended parents or same-sex couples take part?

Not in Ukraine, where the law admits only married heterosexual couples. Georgia accepts married and cohabiting heterosexual couples. For other situations we will say so at the first consultation rather than take your case.

Can we use our own eggs and sperm?

Yes, and at least one of you must be genetically related to the child for both the Ukrainian or Georgian program and the UK Parental Order. Egg or sperm donation is available for the other parent.

How much does surrogacy abroad cost for UK parents?

Ukraine: $41,500–$48,500 (basic) or $57,300–$68,000 (guaranteed). Georgia: $52,500–$62,500 or $75,000–$82,500. Travel, accommodation, apostilles and UK legal fees are extra, and you receive a written quote before signing.

Ukraine or Georgia for UK intended parents?

Ukraine is the more affordable option and has the longest track record with British families: the law has defined the intended parents as the legal parents since 2004, and the birth certificate is issued in your names without a court. Travel is overland from Poland while airspace is closed, and programs take 12–18 months. Ukraine admits married couples only.

Georgia offers direct flights from London to Tbilisi, the same birth-certificate principle and eligibility for cohabiting couples. Programs cost roughly $11,000–$15,000 more. Both are run by the same Militta team with the same coordinator, and we compare the two for your case during the free consultation.
