Ukraine is one of those countries where surrogacy (replacement bearing) is regulated at the legislative level, which means it is allowed and absolutely legal. A woman who agrees to bear someone else’s child, as a rule, receives a monetary reward for her work. She cannot claim any rights to the baby after birth.
However, many childless couples who want to use the program of surrogate motherhood in Ukraine, are often concerned about whether can the surrogate mother at the last moment to change your mind and do not give them a child. Of course, a separate law on surrogacy would help to fully clarify all the features of this procedure, but in our country it is absent. But in the Family Code of Ukraine you can find information about the legal relationship of biological parents with a surrogate mother. The Art. 123, part 2 says that only spouses who have provided their reproductive cells have the right to a newborn child. Therefore, this means that immediately after the birth of the baby , the surrogate mother is obliged to pass it on to the genetic parents.

Surrogacy in Ukraine: laws
In Ukraine, the surrogacy program is regulated by law, which in turn protects the family’s right to have a biologically natural child. Thanks to the legislative framework of our country, many foreign families decide to take part in the surrogacy program in Ukraine.
According to the law, the rights and obligations of the surrogate mother and biological parents are prescribed in advance in a formal contract. This document is the main source that governs the legal relationship of the participants.
Thus, despite numerous stereotypes, beliefs, protests from representatives of religion, some politicians and the public in general, surrogacy is a legal method of treating infertility in Ukraine, which has allowed thousands of couples to become parents of their own child.
